Résumé

Les inspections internationales font interroger au regard de la valeur ajoutée des constatations des inspecteurs sur l’effectivité et l’efficacité de l’application du droit international. Bien qu’étant un moyen de vérification de l’application des accords internationaux, les constatations issues des inspections n’ont pas un effet juridique certain et défini en droit international. Essentiellement factuelle, les constatations ne peuvent produire d’effets juridiques à l’égard de l’État inspecté que de manière subsidiaire et circonstancielle. Les effets juridiques directs probables résultent, soit des modalités d’inspection, soit des modalités de l’usage des constatations dressées. L’inspection internationale demeure un outil de vérification et non de sanction, même si la première peut conduire à la seconde.

Abstract

International inspections raise questions with regard to the added value of the findings of inspectors on the effectiveness and efficiency of the application of international law. Although they are a means of verifying the application of international agreements, the findings of inspections do not have a certain and defined legal effect in international law. Essentially factual, the findings can only produce legal effects with regard to the inspected state in a subsidiary and circumstantial manner. The probable direct legal effects result either from the inspection procedures or from the procedures for using the findings made. International inspection remains a tool of verification and not of sanction, even if the first can lead to the second.
