RESUME :
La constitution nigérienne du 25 novembre 2010 constitue une avancée majeure dans l’architecture des régimes semi-présidentiels en Afrique. Elle représente une curiosité constitutionnelle par son aménagement novateur de la cohabitation, où la légitimité parlementaire du gouvernement coexiste avec la préservation des attributs présidentiels essentiels. Ce dispositif ingénieux démontre une maturation remarquable du constitutionalisme nigérien, transformant la cohabitation d’une simple situation politique en un véritable régime juridique organisé. La distribution fonctionnelle des compétences et la clarification des domaines réservés permettent une gestion apaisée des alternances politiques. Cependant, la suspension de cette architecture sophistiquée après le coup d’Etat militaire du 26 juillet 2023 révèle les limites de l’ingénierie constitutionnelle face aux réalités politiques. Cette trajectoire souligne le défi permanent de l’ancrage démocratique des équilibres institutionnels les mieux conçus.

The Nigerien Constitution of November 25, 2010, represents a major advancement in the architecture of semi-presidential regimes in Africa. It constitutes a constitutional curiosity through its innovative arrangement for cohabitation, where the parliamentary legitimacy of the government coexists with the preservation of essential presidential attributes. This ingenious mechanism demonstrates a remarkable maturation of Nigerien constitutionalism, transforming cohabitation from a mere political situation into a genuine, organized legal framework. The functional distribution of powers and the clarification of reserved domains enable the peaceful management of political alternation. However, the suspension of this sophisticated architecture following the military coup of July 26, 2023, reveals the limits of constitutional engineering in the face of political realities. This trajectory underscores the perpetual challenge of democratically entrenching even the most well-designed institutional balances.
