Résumé

Les juridictions pénales internationales ad hoc ont joué un rôle essentiel dans la clarification et l’humanisation du droit international humanitaire. Leur jurisprudence a permis de mieux qualifier les conflits armés internationaux et non internationaux. Elles se fondent sur des critères objectifs tels que l’intensité des hostilités et l’organisation des groupes armés.

Les notions de contrôle effectif et de contrôle global ont également été précisées. Ces juridictions ont renforcé le principe de la responsabilité pénale individuelle. Elles ont rompu avec la conception traditionnelle d’une responsabilité uniquement étatique. La responsabilité pénale du supérieur hiérarchique y occupe une place centrale. Sa mise en œuvre, ses conditions et ses obligations ont été clairement définies. Enfin, les tribunaux ad hoc ont contribué à la définition des crimes internationaux. Ils ont renforcé la cohérence et l’effectivité du droit international pénal contemporain.

The ad hoc international criminal tribunals have played a crucial role in clarifying and humanizing international humanitarian law. Their case law has made it possible to better characterize international and non-international armed conflicts. These tribunals rely on objective criteria such as the intensity of hostilities and the organization of armed groups.
The notions of effective control and overall control have also been clarified. These jurisdictions have strengthened the principle of individual criminal responsibility, breaking with the traditional conception of responsibility as being exclusively attributed to states. The criminal responsibility of superiors occupies a central place in their jurisprudence, with its implementation, conditions, and obligations being clearly defined. Finally, the ad hoc tribunals have contributed to the definition of international crimes, enhancing the coherence and effectiveness of contemporary international criminal law.
