RESUME

L’office du juge constitutionnel sénégalais s’est réalisé à un rythme temporel variable. On note une certaine lenteur dans la maturation du contrôle de constitutionnalité des lois. Cela est dû à l’image d’un juge autolimité qui verse dans le conservatisme juridique sans l’usage de son pouvoir général d’appréciation. Toutefois, la figure d’un juge pragmatique et audacieux se déploie, par la suite, en  non seulement développant son office de manière fulgurante mais également en procédant à une révolution juridique. Cela a été possible grâce à un large usage de son pouvoir de régulation qu’il exprime à travers la plénitude de ses compétences en matière électorale et à raison de son énorme pouvoir d’interprétation découlant du principe de sécurité juridique, de la stabilité et de la nécessaire continuité du fonctionnement des institutions.

ABSTRACT

The office of Senegalese constitutional judge has developed at a variable pace. We note a certain slowness in the maturation of the control of constitutionality of laws. This is due to the image of a self-limiting judge who lapses into legal conservatism without making use of his general power of appreciation. However, the figure of a pragmatic and audacious judge subsequently unfolds, not only developing his office in a dazzling manner, but also carrying out a legal revolution. This was made possible by the extensive use of his regulatory power, expressed in the fullness of his powers in electoral matters, and by his enormous power of interpretation, stemming from the principle of legal certainty, stability and the necessary continuity of institutional functioning.
