Résumé : Le Burkina Faso traverse depuis 2014 un cas d’atteinte à l’intégrité du territoire qui se matérialise par un conflit armé non international sans précédent exacerbé d’années en années. Les premières réponses à la crise essentiellement militaires n’ont pas donné les réponses attendues compte tenu de la faiblesse structurelle de départ de l’armée burkinabè. Cependant, cette crise sécuritaire a en l’occurrence des répercussions sur la vie scolaire et éducative des enfants burkinabè, dont l’accès à l’école ainsi qu’à la continuité éducative sont pour bon nombre d’entre eux entravés. Or, le Burkina Faso a souscrit au plan international et régional des instruments visant à garantir et à protéger le droit à l’éducation qui fait partie des droits économiques, sociaux et culturels. La protection du droit à l’éducation est ineffective et la justiciabilité de ce droit inachevé en cas d’atteinte à l’intégrité du territoire.

Since 2014, Burkina Faso has been experiencing a case of attack on the integrity of the territory which materializes in an unprecedented non-international armed conflict exacerbated from year to year. The first, essentially military, responses to the crisis did not provide the expected responses given the initial structural weakness of the Burkinabè army. However, this security crisis has repercussions on the school and educational life of Burkinabè children, many of whom have access to school and educational continuity hampered. However, Burkina Faso has subscribed to international and regional instruments aimed at guaranteeing and protecting the right to education, which is part of economic, social and cultural rights. The protection of the right to education is ineffective and the justiciability of this right incomplete in the event of an attack on the integrity of the territory.
