Résumé

Six ans après le fonctionnement effectif du Conseil constitutionnel, considéré comme le gardien de la norme fondamentale du pays, l’arbitre impartial du processus électoral et le régulateur du fonctionnement harmonieux des institutions, il est intéressant de se demander si la bonne administration de la justice y a connu un progrès réel. La réponse à cette problématique, qui reste d’actualité, est sans équivoque. En effet, en dépit des efforts fournis, la bonne administration de la justice, dont la réalisation honore les États, reste mitigée devant le Conseil constitutionnel camerounais. Si elle est actionnée, elle reste encore lacunaire. Elle oscille ainsi entre succès et insuccès, c’est-à-dire entre pas décisif et rocher de Sisyphe. Ce qui permet d’envisager des solutions adéquates en vue de la mise en place d’une justice constitutionnelle de bonne facture, apte à porter davantage sur des fonts baptismaux les valeurs de la démocratie et de l’État de droit.

Abstract

Six years after the effective functioning of the Constitutional Council, considered as the guardian of the fundamental norm of the country, the impartial arbiter of the electoral process and the regulator of the harmonious functioning of the institutions, it is interesting to ask whether the good administration of justice has made real progress. The answer to this question, which is trending, is unequivocal. Indeed, despite the efforts made, the good administration of justice, the achievement of which honours the States, is not entirely the best before the Cameroonian Constitutional Council. Even if it is operational, it still faces challenges. It thus oscillates between success and failure, i.e. between decisive steps and Sisyphean rock. This makes it possible to envisage adequate solutions with a view to the establishment of a constitutional justice of good quality, capable of further raising the values of democracy and the rule of law to a higher level.
