Résumé

L’abus
de droit constitutionnel est un concept particulièrement digne d’intérêt dans
le contexte de transition militaire au Burkina Faso et au Mali, respectivement
à partir des coups d’État de 2022 et 2020. Un droit constitutionnel transitoire est alors
instauré, fondé sur des Chartes et des institutions de transition taillées sur
mesure. Par ailleurs, sous le prétexte sécuritaire, les autorités de transition
procèdent à une restriction des droits fondamentaux, ce qui donne lieu à des
abus de droit constitutionnel. Dans l’exercice du pouvoir, les autorités de
transition sont en quête de légalité à travers une double légitimation qui a
pour but réel d’édulcorer l’abus de droit. La présente contribution a la
modeste ambition d’interroger et de discuter les identifiants de l’abus de
droit constitutionnel.

 Abstract

The abuse of constitutional law is a concept of
particular interest in the context of military transition in Burkina Faso and
Mali, following the coups of 2022 and 2020 respectively. A transitional
constitutional law is then established, based on tailor-made transitional Charters
and institutions. Moreover, under the pretext of security, the transitional
authorities are restricting fundamental rights, which gives rise to abuses of
constitutional law. In exercising power, the transitional authorities are
seeking legality through a double legitimation that has the real purpose of
softening the abuse of law. This contribution has the modest ambition of
questioning and discussing the identifiers of the abuse of constitutional law.
