Résumé

La configuration actuelle du droit de la mer contemporain est essentiellement soucieuse de l’équilibre des pouvoirs juridiques entre  trois figures d’États principaux ayant des compétences en matière de sécurité maritime. Il s’agit de l’État du pavillon, de l’État côtier et de l’État du port. Sous le renouveau, l’objet de cet article est d’analyser les compétences sécuritaires de l’État du port en droit international de la mer pour répondre à la question non encore débattue sur certains aspects ou trop peu débattue sur d’autres de la place de l’État du port dans l’architecture sécuritaire maritime. Il a été démontré, d’une part, qu’une catégorie de compétences nouvelles et exclusives lui est reconnue en matière de police des ouvrages portuaires. D’autre part, les compétences jadis reconnues en matière de navigation ont été accrues et élargies à d’autres domaines vitaux comme la pollution et la pêche. Ces nouvelles compétences rendent l’État du port incontournable dans la nouvelle partition sécuritaire.

Abstract

The current configuration of the contemporary maritime law is essentially concerned with the balance of legal powers between three main State figures with competences in maritime safety. These are the flag State, the coastal State and the port State. Under the revival, the purpose of this article is to analyse the security competences of the port State in international maritime law in order to answer the question of the place of the port State in the maritime security architecture, which is not yet debated in some respects or not sufficiently debated in others. It has been shown, on the one hand, that a category of new and exclusive competences has been recognised in the field of policing of port works. On the other hand, the previously recognised competences in the field of navigation have been increased and extended to other vital areas such as pollution and fishing. These new competences make the Port State an essential part of the new security partition.
