Résumé : Cette étude aborde les diverses problématiques qui touchent à la construction d’un droit humain d’accès à l’eau potable.
Ce droit à l’eau s’inscrit aujourd’hui à la fois dans un schéma international balbutiant, un cadre régional déterminant et une approche nationale en perpétuelle évolution.
Cette analyse détaillée permet de définir la forme, la nature et la portée du droit à l’eau tel qu’actuellement reconnu en droit international, afin de mesurer sa fondamentalité et les limites y afférentes.
Ces réflexions sur le statut juridique du droit à l’eau en droit international permettent ainsi de faire le point sur les avancées progressives enregistrées par celui-ci en termes de reconnaissance, d’application, et d’interprétation tout en relevant les lacunes qui persistent.
L’étude s’attarde à la dichotomie qui existe entre les tensions économiques dans une perspective de la liberté de commerce et les problèmes environnementaux notamment le changement climatique.

Abstract : This study addresses the various issues surrounding the establishment of a human right of access to drinking water.
This right to water is currently part of a fledgling international framework, a decisive regional framework, and a constantly evolving national approach.
This detailed analysis defines the form, nature, and scope of the right to water as currently recognized in international law, in order to assess its fundamentality and the associated limitations.
These reflections on the legal status of the right to water in international law thus provide an opportunity to take stock of the gradual progress made in terms of its recognition, application, and interpretation, while also identifying the remaining gaps.
The study focuses on the dichotomy that exists between economic tensions, from the perspective of free trade, and environmental issues, particularly climate change.
