Résumé
Cet article, en analysant la recomposition de l’État burkinabè dans la région des Kulsé, révèle le paradoxe entre l’extension de l’appareil coercitif face au terrorisme et le délitement du « pouvoir infrastructurel » dans la régulation sociale ordinaire. Fondée sur une approche mixte (288 participants, 37 entretiens menés en 2024), l’étude documente l’évitement des tribunaux formels au profit de médiations endogènes. Mobilisant la sociologie de l’État en recomposition, l’analyse démontre que l’institutionnalisation des mécanismes endogènes de gestion des conflits via la loi Faso Bū-Kaoore traduit une stratégie de « recapture » du local. Ce processus risque de fragiliser la légitimité des acteurs locaux en convertissant leur autorité symbolique en ressource administrative assujettie, érodant l’impartialité constitutive de leur efficacité. L’article déplace ainsi la focale vers la garantie non-coercitive des droits subjectifs dans les marges étatiques.

Abstract
By analyzing the recomposition of the Burkinabè State in the Kulsé region, this article reveals the paradox between an expanded coercive apparatus and the decay of “infrastructural power” in social regulation. Based on mixed-method research (288 participants, 37 interviews conducted in 2024), it highlights the bypassing of formal courts for endogenous mechanisms. Drawing on the sociology of the State in recomposition, the analysis argues that the institutionalization of tradition via the Faso Bū-Kaoore law embodies a strategy of “recapture”. This process risks undermining local legitimacy by turning symbolic authority into a subordinate administrative resource, thereby eroding the impartiality essential to its effectiveness. The paper shifts the focus toward the non-coercive guarantee of subjective rights at the State’s margins.
