RÉSUMÉ

Puisant son existence dans un passé lointain et devant poursuivre son action de contrôle juridictionnel dans un contexte institutionnel et politique rénové, le juge administratif africain parvient-il à garantir aux citoyens la protection du droit contre l’administration ? Par son interprétation constructive de l’acte introductif d’instance du requérant et son travail de rééquilibrage des parties dans la marche du procès, le juge recourt à des modalités d’intervention qui le mettent en mesure de garantir le citoyen contre l’arbitraire administratif. Toutefois, lorsqu’on entreprend d’évaluer les retombées du procès administratif en termes de « vécu quotidien » du requérant, il apparaît que l’œuvre incontestable et significative accomplie à travers la mobilisation des mécanismes contentieux ne permet pas encore de rehausser l’échelle des garanties des citoyens à la mesure des aspirations de nos temps présents. Bien des obstacles réduisent la portée de l’intervention du juge et nécessitent l’amélioration de celle-ci tant dans la recherche de la solution juridictionnelle que dans la construction de la décision.


THE ADMINISTRATIVE JUDGE, RAMPART FOR THE PROTECTION OF CITIZENS AGAINST THE ADMINISTRATION IN FRANCOPHONE AFRICA SOUTH OF SAHARA ?

ABSTRACT

Deriving his existence from a very remote past and having to continue his judicial control in a renewed institutional and political context, does the administrative judge in Africa succeed to guarantee for the citizen his protection against the administration ? Due to his constructive interpretation of the starting act of proceedings for a claimant, and his activity for balancing the parties in the process of the trial, the judge resorts to intervention clauses which make him capable of guaranteeing the citizen against administrative arbitrariness. However, when we undertake to evaluate the results of administrative trails in terms of “the daily life” of the claimant, it appears that the undeniable and significant work which is done through mobilizing the contentious mechanisms, does not yet help raise the level of the guarantees for the citizen to the aspirations of our present time. Many obstacles reduce the importance of the intervention of the judge and need improvement of the latter whether in search for judicial solutions or in the construction of the decision.
