Le coup d’Etat militaire du 26 juillet 2023 intervenu au Niger a entrainé la suspension de la constitution du 25 novembre 2010 et la dissolution de toutes les institutions de la République. Le changement des gouvernements opéré en dehors des procédures normales instaure un vide constitutionnel à combler. C’est dans cette optique que la junte militaire au pouvoir a convoqué des assises nationales à l’issue desquels une charte de la Refondation a été adoptée avant d’être promulguée par le Chef de l’Etat. Cette Charte à valeur constitutionnelle consacre une organisation des pouvoirs publics marquée par un net déséquilibre en faveur de l’exécutif dans les rapports entre les organes de la Refondation. Ce déséquilibre s’est davantage consolidé avec l’absence de contrepouvoir institutionnel du fait de l’inexistence d’un organe assumant les fonctions parlementaires et d’une juridiction constitutionnelle. L’organisation des pouvoirs publics pendant la période de la Refondation présente de ce fait des lacunes qui ont été décelée et examinée.

ABSTRACT
The military coup d’état of July 26, 2023, in Niger resulted in the suspension of the Constitution of November 25, 2010, and the dissolution of all institutions of the Republic. This change of government, effected outside standard procedures, created a constitutional vacuum that needed to be filled. Against this backdrop, the ruling military junta convened a national forum, culminating in the adoption and subsequent promulgation by the Head of State of a « Refoundation Charter. » This Charter, which holds constitutional status, establishes a structure of public authority characterized by a marked imbalance favoring the executive branch in the relationships between the various Refoundation bodies. This imbalance was further entrenched by the absence of institutional checks and balances, resulting from the lack of both a parliamentary body and a constitutional court. Consequently, the organization of public authority during the Refoundation period exhibits shortcomings that have been identified and examined.
