Résumé :

Les Constitutions des pays africains, notamment d’Afrique francophone, accordent une place importante aux obligations du citoyen. Cela montre que la conception très répandue de la Constitution comme instrument essentiellement de limitation du Pouvoir est nuancée en Afrique. La constitutionnalisation des obligations du citoyen est, d’une part, relative à la protection des droits fondamentaux et à la défense des intérêts nationaux, et, d’autre part, aux impositions, à l’environnement, aux valeurs socioculturelles africaines. La reconnaissance des obligations constitutionnelles du citoyen est certainement l’une des contributions majeures de l’Afrique au droit constitutionnel.

Abstract:

The Constitutions of African countries, especially in French-speaking Africa, place an important emphasis on the duties of the citizen. This shows that the widespread conception of the Constitution as an essentially instrument of Power limitation is relative in Africa. The constitutionalisation of citizen’s obligations concerns, on the one hand, the duties relating to protection of fundamental rights and national interests defence, and, on the other hand, those relating to impositions, environment and African socio-cultural values. This is certainly one of the main contributions of Africa to constitutional law.
