Résumé 

L’agencement des obligations de la personne détenue dans de nombreux textes africains relatif au régime pénitentiaire manque de cohésion structurelle. En plus, certains de ces textes brillent par une imprécision et/ou par un silence notoire sur l’encadrement de certaines desdites obligations, ainsi que sur le régime des sanctions de leur violation. À ces écueils, s’ajoutent l’impact négatif des fléaux sociaux et économiques qui minent la plupart des États africains sur l’élan d’humanisation du statut des détenus. Il en découle la nécessité de cerner le contenu des obligations en question afin d’aboutir à leur classification cohérente et à l’appréciation de leur mise en œuvre à l’aune des exigences universelles liées au respect de la dignité humaine.  Tel est l’enjeu de cet essai de systematisation des obligations de la personne détenue dans les États d’Afrique noire francophone.

Summary

The arrangement of the obligations of detainees in many African texts relating to the penitentiary system lacks structural cohesion. Furthermore, some of these texts are notable for their imprecision and blatant silence regarding the regulation of certain of these obligations, as well as the system of sanctions for their violation. Adding to these obstacles is the negative impact of the social and economic ills plaguing most African states on the progress towards humanizing the status of detainees. This underscores the need to define the content of these obligations in order to arrive at a coherent classification and an assessment of their implementation in light of universal requirements related to respect for human dignity. This is the aim of this attempt to systematize the obligations of detainees in Francophone sub-Saharan African states.
