Résumé

Intitulé : L’autorité des avis du juge constitutionnel en Afrique francophone

Les Constitutions des Etats de l’Afrique francophone prévoient des procédures permettant au juge constitutionnel de donner des avis à la demande des autorités limitativement énumérées. Ces avis sont émis, d’une part, sur la constitutionnalité des actes et procédures et, d’autre part, sur le sens et la portée de telle ou telle disposition de la Constitution. Dans certains Etats sous étude, l’avis ainsi émis est revêtu de l’autorité reconnue aux décisions ou arrêts rendus au contentieux. Dans d’autres, en revanche, il a été postulé en raison de la convergence des modalités et des buts entre les deux actes (décision/arrêt et avis) par lesquels le juge saisi s’exprime. Summary Title : The authority of opinions of the constitutional judge in French-speaking Africa French

The Constitutions of French-speaking African States provide for procedures allowing the constitutional judge to give opinions at the request of the authorities listed below. These opinions are expressed, on the one hand, on the constitutionality of acts and procedures and, on the other hand, on the meaning and scope of such or such provision of the Constitution. In some States under study, the opinion thus issued is vested with the authority recognized for decisions or judgments rendered in litigation. In others, however, it has been postulated because of the convergence of the methods and the aims between the two acts (decision / judgment and opinion) by which the judge seized expresses himself.
