Résumé :

La crise climatique constitue un défi majeur pour les hautes juridictions africaines, appelées à garantir la justiciabilité du droit à un environnement sain. L’analyse de l’office de contrôle des juridictions fondamentales africaines met en lumière les dynamiques d’expansion des compétences juridictionnelles. La tendance au niveau régional, révèle la timide émergence d’une justice climatique africaine malgré les restrictions institutionnelles, les lacunes normatives et les difficultés d’exécution des décisions. L’étude soutient la construction d’un véritable droit climatique africain par l’adaptation des cadres normatifs, l’harmonisation régionale et le renforcement des mécanismes contraignants. Pour ce faire, l’office du juge, loin de se réduire à une fonction de contrôle, devient un instrument de régulation actif, indispensable à la gouvernance climatique sur le continent.

Abstract :

The climate crisis is one of the major challenges for African fundamental courts, which are called upon to guarantee the justiciability of the right to a healthy environment. The analysis by the office for the monitoring of African fundamental Jurisdictions, highlights the dynamics of the expansion of jurisdictional powers. The regional trend reveals the tentative emergence of African climate justice, despite institutional restrictions, regulatory gaps and difficulties in enforcing decisions. The study supports the development of a genuine African climate law through the adaptation of normative frameworks, regional harmonisation and the strengthening of binding mechanisms. To this end, the role of the judge, far from being reduced to a supervisory function, becomes an instrument of active regulation, indispensable to climate governance on the continent.
